Welcome to Elevated Fishing. By downloading, installing, or using the Elevated Fishing mobile application ("the App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the App.
Elevated Fishing is a personal fishing log application that allows you to record catches, photos, GPS locations, weather conditions, and related data. The App is intended for personal, non-commercial use. You must be at least 13 years of age to use the App.
The App allows you to log up to 10 fish catches at no cost. After reaching this limit, a paid subscription is required to continue logging new catches. All previously logged catches, including viewing, editing, maps, analytics, and sharing features, remain fully accessible without a subscription.
Subscriptions are billed through Google Play on a monthly or annual basis, depending on the plan you select at checkout. By subscribing, you authorize Google Play to charge the applicable subscription fee to your payment method on a recurring basis at your chosen interval. Prices are displayed in your local currency at the time of purchase.
Your subscription will automatically renew at the end of each billing period (monthly or annually, depending on the plan you selected) unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time through your Google Play account settings.
Refunds are handled by Google Play in accordance with their refund policies. We do not process refunds directly. If you believe you are entitled to a refund, please contact Google Play support.
All data you enter into the App — including catch records, photos, GPS coordinates, and settings — is stored locally on your device. We do not have access to your data and cannot recover it if your device is lost, damaged, or reset. You are responsible for backing up your data using the App's export feature.
The App includes AI-powered fish species identification and photo-based length measurement features. These are provided as tools to assist you and are not guaranteed to be accurate. Species identification results are estimates based on image analysis and should not be relied upon for regulatory compliance, tournament scoring, or any purpose requiring verified identification. Always verify species identification and measurements independently.
Weather information is provided by the National Weather Service and other third-party sources. This data is provided "as is" without warranty of accuracy, timeliness, or completeness. GPS coordinates are captured using your device's location services and may vary in accuracy.
The App, including its design, code, logos, graphics, and content, is owned by SM Consulting LLC and is protected by applicable intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works from the App.
To the maximum extent permitted by law, Elevated Fishing and SM Consulting LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of catches, inaccurate measurements or identifications, or interruption of service.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We reserve the right to modify, update, or discontinue the App or any of its features at any time without prior notice. We may also update these Terms from time to time. The revised Terms will be posted on this page with an updated effective date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
You may stop using the App at any time by uninstalling it from your device. If you have an active subscription, you must cancel it separately through Google Play to stop future charges. Uninstalling the App does not automatically cancel your subscription.
These Terms shall be governed by and construed in accordance with the laws of the State of North Dakota, United States, without regard to its conflict of law provisions.
